Video Shows Border Patrol Agent Punching Teen in Stomach

TUCSON, Ariz. (AP) — For nearly eight months after federal investigators saw videos of a U.S. Border Patrol agent punching a teenager in the stomach, the agent continued to work and went unpunished.

The agent, Aldo Arteaga, a nearly 10-year veteran, is now facing an assault charge in Santa Cruz County.

Arteaga was charged last week with felony aggravated assault, which applies in Arizona when an adult is accused of assault on a minor under age 15. But the charge was reduced to a misdemeanor Thursday because the teen Arteaga is seen punching was 15 years old during the Jan. 30 incident.

Fake cop shows teen weapon in Palo Alto

A man impersonating a police officer pulled a weapon on a teenager, chastising him for the way he was riding his bike, police said Friday.

The incident happened about 4 p.m. Sept. 5 as two teenage boys, both high school students, rode their bikes in a bike lane on Channing Avenue near Rhodes Drive.

They heard a voice on a public-address system in a car behind them ordering them to ride single file instead of side by side. When they looked back, they saw a car with no police markings, but assumed it was an unmarked police vehicle.

The teens complied with the stranger’s demands and separated at Greer Road.

That’s when the man followed one of the youths and again used the PA system, this time ordering the boy to stop, police said.

“When the student looked back, he saw flashing police-style lights emanating from inside the car,” police said.

The teen stopped his bike and the man pulled up alongside him, displayed a badge and “proceeded to angrily lecture him about his riding habits,” police said. The man then pointed either a stun gun or handgun at the roof of his car so the student could see it before driving away.

Police released a sketch of the man, described as a white male in his 60s with balding, short gray hair. He was about 5-foot-10 with a heavy build and wore a light blue collared shirt, similar to a uniform shirt.

The badge he displayed was silver but had a color design on it, with a green tree in the center. The man’s car was a cream-colored, four-door sedan with radio antennas on the roof.

Anyone with information is asked to call Palo Alto police at (650) 329-2413.

Andy Lopez mural goes up in Roseland

Three miles from where 13-year-old Andy Lopez was shot and killed by a Sonoma County sheriff’s deputy nearly a year ago, a mural of the boy went up.

Santa Rosa artist Mario Uribe installed Friday the temporary 8-foot-by-16-foot mural along the side of a vacant gas station at West Avenue and Sebastopol Road in the heart of Roseland. It’s one of the busiest intersections in the southwest Santa Rosa neighborhood, which was rattled by the fatal Oct. 22 shooting by Sonoma County Sheriff’s Deputy Erick Gelhaus, who reportedly mistook the airsoft BB gun Lopez was carrying for an AK-47 assault rifle that it was designed to resemble.

Erick Gelhaus, deputy who shot 13 year old Andy Lopez, returning to patrol

Sonoma County Sheriff’s Deputy Erick Gelhaus will return to patrolling the streets next week, nearly 10 months after he shot and killed 13-year-old Andy Lopez, sparking protests that revealed deep distrust of law enforcement among some residents, especially those in the Latino community.

The Sonoma County District Attorney’s Office in July cleared Gelhaus of any criminal wrongdoing for his actions in the fatal Oct. 22 shooting, which ignited an emotional debate about officers’ use of deadly force and the dangers of toy guns made to look like real firearms.

Lopez was shot while walking down a residential street on Santa Rosa’s southwest outskirts carrying an airsoft BB gun made to resemble an AK-47 assault rifle. Gelhaus told investigators he ordered the boy to drop the gun, then opened fire when Lopez turned toward the deputy, partially raising the barrel of the gun.

Gelhaus did not return a call seeking comment about his return to patrol duties. His attorney Terry Leoni said in an email that the veteran deputy welcomed “this assignment, and knows his nearly 25-years in law enforcement will continue to benefit the community.”

“He will continue to proudly serve the people of Sonoma County, as he has always done,” Leoni said.

Gelhaus, a firearms instructor in the Sheriff’s Office, has been back at work since December, largely in administrative assignments within the department. His return to patrol, including a wide range of duties interacting with the public, marks another potent moment in what has been a painful and tumultuous chapter in Sonoma County history.

For those who have continued to protest the deputy’s actions, news of Gelhaus’ return to patrol was met with surprise and a sense that their concerns had gone unheard.
