Man Says Border Patrol Ran Him Down

LAREDO, Texas (CN) – A Border Patrol agent chased down an unarmed fleeing man and ran him over, a reckless pursuit that got the agent’s vehicle stuck on the banks of the Rio Grande, the injured man claims in court.
Rogelio Marquez Rodriguez, 36, says he “crossed into the U.S. from Mexico, without inspection, to pursue dignified, fair, lawful economic opportunities” and was rudely greeted by overzealous Border Patrol agent Richard Edward Oelfke-Philip.
Marquez sued the United States of America on Tuesday in Federal Court. Oelfke-Philip is not a defendant.
Marquez says he did not have a weapon, nor did he fight with or threaten Oelfke-Philip before the officer saw him running toward the river on Aug. 18, 2012 in Laredo and hit the gas.
“Due to the violent force of the impact, Mr. Marquez’s body was thrown a few feet away from the vehicle and it immediately caused him serious personal injuries and severe pain, suffering and discomfort that left him splayed on the ground unable to get up,” the complaint states.
Marquez suffered a broken arm and back injuries that still give him shooting pains three years later, he says.

José Antonio Elena Rodríguez was 16 when he was gunned down on a street in Nogales, Mexico, in October 2012. He was shot several times in the back by a United States Border Patrol agent, firing through the fence from Nogales, Ariz. The boy was unarmed; his family said he had been walking home from a basketball game.

U.S. Customs And Border Protection To Decide On Body Cameras

U.S. Customs and Border Protection will decide whether or not to use body-worn cameras before the end of this year, according to an official in charge of a nine-month study of the technology.
The study was launched in October 2014 as part of a response to use-of-force complaints involving border patrol agents. The cameras were used in training and in the field, in land, air and maritime environments. The department’s Body-Worn Camera Working Group is now compiling the findings and writing a report for Commissioner Gil Kerlikowske.

Criminal justice student tased at border checkpoint after refusing trunk search, resisting order to move [VIDEO]

WADDINGTON — An Ogdensburg woman and Lisbon Central School graduate studying criminal justice at SUNY Canton was tackled and Tased by border agents following a confrontation at a Waddington immigration checkpoint that was captured on video.

Jess Cooke, 21, said she was pulled in for a secondary inspection after agents said she appeared nervous at the checkpoint. Cooke said she refused a search of her trunk and was asked to wait for a K-9 Unit to arrive.

A conversation with officers escalated and she was tackled and Tased after she resisted an agent who had grabbed her after she refused to comply with a request for her move.

“I was cuffed for over an hour after being out in the Border Patrol car and then brought to the U.S. Customs station in Ogdensburg. I sat there for a good 3-4 hours and got sent home due to they couldn’t figure out what charges to put on me,” Cooke said in a written response.

Cooke said she received scrapes and cuts on her legs, back and chest. She said her wrists are also marked from the handcuffs.

Cooke said her car was searched and found to be clean, but she is awaiting potential charges regarding the struggle.

Cooke said she has a two-year degree in criminal justice will graduate Saturday from SUNY Canton for law enforcement leadership with a four-year degree.

Cooke said she had hoped to pursue a career in the Border Patrol, but the incident has changed her mind.
