It’s been almost two years since 16-year-old José Antonio Elena Rodríguez was killed in the Mexican town of Nogales as he walked down a street close to his home near the U.S.-Mexico border. According to reports, on the night of Oct. 10, 2012, an unidentified Border Patrol agent opened fire on José through the steel-beamed border fence that stands on a cliff above the street where he was walking.
José was shot at least 10 times as he stood on Mexican soil — by an agent standing on U.S. soil.
Until recently, José’s family believed it was likely no one would be held responsible for his death. Since the bullets that killed José traveled from the U.S. into Mexico and because José was not a U.S. citizen, finding justice under the Constitution has been an uphill battle.

San Diego, CA: The district court judge presiding over the civil case involving the family of Anastasio Hernandez Rojas has cleared the way for trial and denied the claims of border agents’ that they are immune from the lawsuit. The federal government filed a motion arguing that the border agents involved in the use of force against Anastasio are immune from civil liability, asserting that their conduct did not violate any constitutional rights. The judge disagreed, dismissed the government’s claim and cleared the way for the civil case to go to trial. Anastasio was a long-time San Diego resident and a father of 5 who was beaten and shot repeatedly with a taser by border agents resulting in his death near the San Ysidro Port of Entry in May 2010.

The new Customs and Border Patrol Protection Head of Internal Affairs admitted there are more than 100 cases of excessive force by agents that need to be looked at again.

DENVER (AP) — Five Denver sheriff’s deputies followed the rules when they used a sleeper hold and stun gun to restrain a homeless street preacher who died in the downtown jail, a defense attorney said Monday.
The comments by Denver attorney Thomas Rice came during opening statements in a federal civil trial involving the deputies accused of using excessive force in connection with the death of Marvin Booker.

Surveillance footage played in court shows three officers wrestling Booker onto chairs then down to the floor before two others join the scuffle. One puts his arm around Booker’s neck for about three minutes. Officials said at the time that a deputy warned Booker to stop resisting.
An autopsy report said deputies had their body weight on Booker’s back for four minutes while he was face-down on the floor.
The video also shows deputies carrying Booker’s limp body to an isolation cell after one of them stunned him for at least eight seconds.
Newman said deputies showed no concern for Booker’s health after the incident and should have summoned medical care sooner.
