Overkill

Natick

The police in and around Ferguson have shot and killed twice as many people in the past two weeks (Mr Brown plus one other) as the police in Japan, a nation of 127m, have shot and killed in the past six years. Nationwide, America’s police kill roughly one person a day (see chart).

This is not because they are trigger-happy but because they are nervous. The citizens they encounter have perhaps 300m guns between them, so a cop never knows whether the hand in a suspect’s pocket is gripping a Glock. This will not change soon. Even mild gun-controls laws tend to fail.

How Police Caught The Cop Who Allegedly Sexually Abused 8 Black Women

“Prosecutors say Officer Daniel Holtzclaw made a mistake after a series of sexual assaults on black women in Oklahoma City — he profiled the wrong woman. His family says he’s a victim of “solicited testimony” from women who have “personal motives” to lie. BuzzFeed News reports from the Oklahoma County courtroom where, Wednesday, prosecutors described a pattern of sexual harassment and assault.”

DOJ Investigation Of Ferguson Police Department

On August 29, 2014, I wrote that when searching for a copy of the $40 million lawsuit filed against the Ferguson, MO police department, that I discovered other lawsuits that name various Ferguson police officers as defendants. In that post, I also wrote that the U.S. Department of Justice has a division to receive and investigate complaints against law enforcement who violate civil rights under color and claim of official right. Considering that some citizens of Ferguson stated that no private attorney was willing to go against Ferguson, it was my opinion that their only option was to file complaints with the DOJ’s Civil Rights Division.

Today, U.S. Attorney General Eric Holder held a press conference announcing that the Department of Justice has opened an investigation into the Ferguson police department. The video is below. Please note that he says the investigation includes if the Ferguson police department has violated the constitution and/or federal law.   Those are two different things under the DOJ.

NYPD Chief Ignores A Quarter of Police Misconduct Rulings

It’s rare enough that citizens file complaints against the police and even rarer that those complaints are investigated. So, it’s appalling to hear that in 25% of cases where a NYPD police misconduct review board ruled that an officer be disciplined, Chief Bill Bratton did nothing. The New York Times has the story:

In the first six months of 2014, the department has declined to sanction officers in over 25 percent of cases in which the board found cause for discipline. That rate is near the high end of what was seen during the last years of the Bloomberg administration, when Mayor Michael R. Bloomberg and Commissioner Raymond W. Kelly were generally hostile to external oversight.

How officers are disciplined has come under new scrutiny following the death of Eric Garner during an arrest that included, the city medical examiner said, the use of a chokehold, which is banned by…

Death by Law Enforcement: What the data tells us – and what it doesn’t

“When a police officer kills someone while trying to stop a crime or make an arrest, government agencies classify the death as a legal intervention. The death of Mike Brown, the 18-year-old and unarmed teenager killed by a police officer earlier this month in Ferguson, Missouri will likely be classified under this term when it comes time to report the circumstances of his death to the national databases that track such information.”
