Yet at least a quarter of the 28 deaths were “highly suspect,” said James F. Tomsheck, the agency’s recently removed head of internal affairs. In a sweeping and unauthorized interview with The Center for Investigative Reporting, he said the deaths raised serious questions about whether the use of lethal force was appropriate.

Instead, Tomsheck said, Border Patrol officials have consistently tried to change or distort facts to make fatal shootings by agents appear to be “a good shoot” and cover up any wrongdoing.

“In nearly every instance, there was an effort by Border Patrol leadership to make a case to justify the shooting versus doing a genuine, appropriate review of the information and the facts at hand,” he said.

Those comments and others represent the most scathing public criticism ever lodged against Customs and Border Protection from a high-ranking official at the nation’s largest law enforcement agency. Although Tomsheck was removed from the internal affairs office, he is assigned to the Border Patrol as its executive director for national programs.

NYPD Drag Naked Woman From Apartment, Leave Her Passed Out On The Floor

 

Denise Stewart, 48, who suffers with severe asthma, screamed “I can’t breathe” as she struggled to get away from police officers who held her against a wall after pulling her from her apartment on July 13.

The incident is all captured on video.

According to the Daily News, officers said they were called to the building to respond to a possible domestic violence dispute.  Stewart’s lawyer claims the 911 call came from an apartment on another floor

After the funeral, as Kirkpatrick, Bryant and his children were leaving the church, they were approached by a group of plainclothes cops. Kirkpatrick says he was asked, “Is that your cousin, Calvin Bryant?” When he confirmed Bryant’s identity, he says, police followed them down the block and arrested Bryant.

In addition to an outstanding bench warrant, Bryant was charged with resisting arrest. According to the arrest document, “The defendant did resist a lawful arrest by flailing the defendant’s arms and pushing the deponent while the deponent attempted to place the defendant in handcuffs.”

Bryant and Kirkpatrick vehemently deny that accusation. “I didn’t resist arrest,” Bryant says. “I didn’t have time. I was holding my kids’ hands so I wouldn’t have been able to throw my hands up.”

What Bryant and his lawyers do find troubling is the time and place of an arrest that could have been made somewhere else, and at any other time.

“Why on earth choose this moment?” asks Scott Hechinger, one of the lawyers working on Bryant’s case. “There’s about a million other ways to arrest this guy. Get him at his house the day before, the day after, any time over the last four years. Why choose the funeral service—the service that they caused—to inflame tensions? The timing just makes you wonder: Is this to make a statement?

Testimony: DHS agents admit reports falsified

A special agent who replaced a Department of Homeland Investigations-Office of Inspector General supervisor in McAllen testified Monday that he couldn’t believe several agents told him they falsified reports.

However, the article goes on to say:

 

“As part of that process, Green would fill out a file review worksheet and place it with the case file, he testified. The file review worksheet would identify what work had been done on cases and set goals for agents to work toward.

In March 2012, when Green was set to conduct his second round of file reviews, he discovered that most of the 100 or so cases were missing the worksheets, which had been there during the first review, he testified.”

Sheriff’s Report on Migrant Killing Raises Concern About Impartiality

 

“San Diego: On Tuesday, February 18 at approximately 6:40 AM, a Border Patrol agent shot and killed 41 year-old Jesus Flores-Cruz, a Mexican national, while in a rural area of San Diego County about 5 miles north of the Otay Mesa border crossing. The name of the Border Patrol agent has been withheld.

 

The San Diego County Sheriff’s press report on the homicide describes the person killed as the “suspect” and the person who killed him as the “victim.”

 

In response, Pedro Rios, the program director for the American Friends Service Committee in San Diego, issued the following statement on behalf of the Southern Border Communities Coalition (SBCC):

 

“We are concerned that the San Diego County Sheriff’s Department is predisposing this investigation to bias by identifying the person shot and killed as a suspect at the initial stages of the investigation. This positioning endangers the impartiality in this case and our coalition has asked the Department of Justice to intervene to ensure a thorough and impartial investigation. The Justice Department is now reviewing the incident.”
